That is, they 15 CONDUCTING LAW AND SOCIETY RESEARCH had to have an informed intuition to find the substantively right result. 1 But the impetus behind my interests was very practical. I was a law professor, and, like many if not most American law professors, I had never practiced law or worked in a business. I had a job to do, but I felt that I didn’t know enough. Once I began teaching, I worked my way through two excellent contracts casebooks, and I checked Corbin on Contracts as I fashioned notes for my classes.
And once the questions became clearer then my mental categories from the literature, particularly about devising the structuring of regulatory agencies, became clearer. Then I went through the typed notes and coded. I allocated my specific stories and observations to different questions and subquestions, chapters and subchapters, in my emerging outline. I wrote a long discursive outline. I also hit upon the idea of going back to Washington and studying the files, doing a more systematic sample of cases.
That’s one of the big downsides when people write about research methods – it is all so neat and pretty. The messiness of much of it just doesn’t come through in the books. I certainly knew that I didn’t want all the business people to work for manufacturers of consumer products such as my father-in-law. I knew that I should try to find people from other kinds of business. I knew that I didn’t want them all to be from Racine, the city where Johnson Wax was located. And I knew that the friends of my father-in-law might differ from most business people because he was an atypical executive for his time who worked for a family-owned major corporation, and his friends might be more like him than typical people in these roles.
